1. Scope and Provider / Restriction of Offer
These General Terms and Conditions (hereinafter "Terms") govern the contractual relationship between the user (hereinafter "Customer") and the provider regarding the sale and licensing of digital content (wallpapers) via the website wallpapr.io.
Territorial Restriction: The offer on this website is directed exclusively to consumers with their habitual residence in the following countries:
European Union (EU): Austria (AT), Belgium (BE), Bulgaria (BG), Croatia (HR), Cyprus (CY), Czech Republic (CZ), Denmark (DK), Estonia (EE), Finland (FI), France (FR), Germany (DE), Greece (GR), Hungary (HU), Ireland (IE), Italy (IT), Latvia (LV), Lithuania (LT), Luxembourg (LU), Malta (MT), Netherlands (NL), Poland (PL), Portugal (PT), Romania (RO), Slovakia (SK), Slovenia (SI), Spain (ES), Sweden (SE).
International: United States (US), Australia (AU), Japan (JP), Singapore (SG), New Zealand (NZ), Malaysia (MY), Thailand (TH).
We do not conclude contracts with customers from other countries (e.g., United Kingdom, Switzerland, Norway). Orders from outside these regions will be rejected or refunded.

2. Contract Conclusion
The presentation of products on wallpapr.io does not constitute a legally binding offer, but an invitation to place an order.
Order Process: By clicking the "Buy Now" (or similar) button and completing the checkout process, the Customer submits a binding offer to purchase the digital content.
Contract Formation: The contract is formed when we accept your offer. Acceptance occurs immediately after successful payment by providing the download link (via the website or email confirmation).
Payment Processing: We use Stripe as our payment processor. While the contract is concluded directly with us, the financial transaction is handled securely by Stripe.
3. Product Description and System Requirements
Digital Products: The products offered are digital image files (e.g., in JPG, PNG, or HEIC format) intended for use as wallpapers on electronic devices. No physical products will be shipped.
Representation: The display of products on the website serves as a non-binding digital catalog. Minor deviations in color between the screen display and the file are technically possible and do not constitute a defect.
Requirements: To use the products, the Customer requires a device capable of displaying common image formats and an internet connection for the download.
4. License and Usage Rights (Crucial)
With the purchase and download of a wallpaper, the Licensor grants the Customer a non-exclusive, non-transferable, perpetual, worldwide license to use the image file under the following strict conditions:
5.1 Permitted Use (Private Only)
The Customer is allowed to:
- Download and save the file on personal devices (Smartphone, Tablet, PC, Laptop).
- Set the image as a background/wallpaper on these devices.
- Edit, crop, or modify the image solely for the purpose of fitting it to the Customer's personal screen (e.g., color correction for personal taste).
- Create backup copies for personal archival purposes.
5.2 Prohibited Use (Restrictions)
The Customer is strictly PROHIBITED from:
- Commercial Use: Using the image for any commercial, professional, or promotional purposes (e.g., in advertisements, marketing materials, or company presentations).
- Resale & Distribution: Selling, licensing, renting, or lending the file to third parties.
- Sharing: Uploading the file to file-sharing platforms, cloud drives accessible to the public, or "wallpaper sites."
- Publishing: Posting the file in its original or modified form on social media (e.g., Instagram posts, Tweets) or websites where the primary intent is to share the image file itself.
- Merchandising: Using the image on physical products for sale (e.g., T-shirts, mugs, posters).
- AI Training: Using the image for machine learning or training artificial intelligence systems.
Intellectual Property: The Customer acknowledges that the digital content remains the intellectual property of Pawel Lebek. The purchase grants a right of use, not ownership of the copyright.
5. Prices and Payment
Prices: The prices listed on the website are total prices.
EU Customers: Since the Provider is a small business operating below the EU cross-border turnover threshold (Art. 59c VAT Directive), German VAT (19%) is included in the price for all customers residing in the European Union.
Non-EU Customers: For customers outside the EU (e.g., USA, Australia), the prices are generally net prices (0% VAT), unless local tax laws require us to collect sales tax depending on our turnover in that specific region. The Customer is responsible for any local import duties or taxes if applicable in their jurisdiction and if not collected by us at checkout.
Payment Methods: Payment is processed securely via Stripe. We accept the payment methods displayed during the checkout process (e.g., Credit Card, Apple Pay, Google Pay, Link).
Due Date: The purchase price is due immediately upon conclusion of the contract.
6. Delivery
Delivery takes place immediately after payment confirmation by providing a download link.
The download link is either displayed directly in the browser or sent to the email address provided by the Customer via our email service providers (Resend/Brevo).
The Customer is responsible for ensuring that the provided email address is correct and that the email is not blocked by spam filters.
7. Right of Withdrawal (Cancellation Policy)
Consumer Waiver for Digital Content
As a consumer, you generally have a statutory right of withdrawal. However, for contracts regarding the delivery of digital content not on a physical medium, the right of withdrawal expires prematurely if certain conditions are met.
By purchasing and downloading our content, you expressly agree that:
- The contract execution (provision of the download) begins before the expiration of the statutory withdrawal period.
- You acknowledge that you lose your right of withdrawal once the download has started.
Refund Policy: Due to the nature of digital goods, we generally do not offer refunds once the file has been downloaded. Exceptions are made at our sole discretion or in cases of technical defects (see Section 9). If you have issues, please contact contact@reviewstudios.io.
8. Warranty and Defects
Statutory Warranty: The statutory warranty rights apply to the digital products. We ensure that the digital content meets the contractual agreements and is suitable for normal use (as a wallpaper).
Technical Issues: If a downloaded file is defective (e.g., corrupted file, incorrect resolution), the Customer must contact support immediately. We will provide a replacement file free of charge.
Compatibility: We do not guarantee compatibility with future device updates or specific third-party software beyond standard image viewers.
9. Liability
To the fullest extent permitted by law, the following liability rules apply:
- Unlimited Liability: We are liable without limitation for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), and for injury to life, body, or health.
- Limited Liability: In cases of slight negligence (leichte Fahrlässigkeit), we are only liable for the breach of essential contractual obligations (cardinal duties). Cardinal duties are those whose fulfillment is necessary for the proper execution of the contract and on whose observance the Customer may rely. In these cases, liability is limited to the typical, foreseeable damage.
- Exclusion: Any further liability (e.g., for lost profits, data loss, or indirect damages) is excluded, provided this is legally permissible.
- US Residents: For customers in the USA, liability is limited to the amount paid for the product, except where prohibited by law.
10. Data Protection
We process personal data in accordance with our Privacy Policy. Payment data is processed securely by our payment processor Stripe. Please refer to our Privacy Policy for details.
11. Final Provisions
Governing Law: These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Consumer Protection: If the Customer is a consumer with habitual residence outside Germany, mandatory consumer protection provisions of the law of the country in which the Customer resides shall remain applicable and unaffected by the choice of German law.
Online Dispute Resolution: The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are not obligated and not willing to participate in dispute settlement proceedings before a consumer arbitration board.
Severability: Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
